The Company may amend or revise the Agreement or modify the Rules of Conduct at any time in its sole discretion. Such amendments shall be effective immediately upon posting. Your use of the Games after the effective date of any amendment will be regarded as acceptance of all changes.
The Company offers various games as a free online game service accessible via the internet. It reserves the right to change the URL address of the website at any time. The Company shall not be responsible for any fees and charges incurred in establishment, usage, or termination of your Internet Service.
Subject to the terms of this Agreement, the provided service is for your personal use only — a non-exclusive, revocable, nontransferable license. You may not sublicense, rent, lease, loan, transfer, modify, adapt, reverse engineer, or otherwise attempt to derive source code from the Software.
Eligibility. Individuals of all ages are eligible to establish a policy. If you are under 13 years of age, we recommend that your parent(s) or guardian(s) complete the registration process and accept full responsibility for all obligations stated in this Agreement.
Policy. You must choose a unique policy ID. You may not select a name that violates any third party's trademark right, copyright, or other proprietary right, or which the Company deems vulgar or offensive. You have sole liability for all activities conducted through your policy.
Character & Guild Names. You may not use names that infringe on third-party rights or mislead others into believing you are a Company employee. The Company reserves the right to delete or alter any offensive names.
Password. You are responsible for maintaining the confidentiality of your password. The Company will never ask for your password online or offline.
Registration Obligation. You agree to provide true, accurate, current, and complete information. If you provide inaccurate information, the Company has the right to suspend or terminate your policy.
Termination & Multiple Policies. Former members whose policies have been terminated may not access the Service through any other policy. The Company may terminate related policies sharing identical contact or payment details.
Current fees for using the Service are free. You are responsible for all fees associated with your Internet connection.
The Company may offer various game items and nCash for purchase. Any out-of-game or out-of-provided Web Sites selling and/or purchasing activities of Game Items and nCash are strictly prohibited. GAME ITEMS AND nCASH ARE NOT REFUNDABLE FOR ANY REASON WHATSOEVER. Game Items and nCash you purchase are properties of the Company. You are fully liable for all charges under your policy, including any unauthorized charges.
Trading of Game Items between Players is permitted only through the Websites. All other trading or transference activities — including trading of nCash, policy IDs, and all out-of-game transfers — are strictly prohibited. The Company shall not be responsible for any losses from trading activities, and any prohibited conduct may result in immediate termination of the policy involved.
Members may not engage in any unlawful conduct or communication that restricts other Members from using the Service. Prohibited conduct includes but is not limited to:
Use of cheating programs such as macros, bots, or mouse emulators is strictly prohibited and may result in policy suspension or termination.
The Games are designed for official play only as offered through the Service. You agree not to create or provide any other means through which the Games may be played by others, including server emulators. You may not sell or auction any Game policies, characters, items, coins, or copyrighted material.
Our privacy policy covers the usage and protection of your personal information and is published on the Web Sites at http://www.netgame.com.
Parents may find certain content inappropriate for minors. The Company does not, as a matter of policy, pre-screen all materials or communications transmitted by each player. Parental discretion is advised.
The Company reserves the right to interrupt the Service at any time for maintenance. It shall not be liable for any interruption, delay, or failure to perform from any cause whatsoever. The Company is not obligated to refund any Game Item or nCash purchases due to service interruptions.
Closed Beta Tests are confidential. Participants must safeguard all beta game information and not provide access to others. Your obligation to keep the beta games confidential continues until the Company publicly distributes the content.
All Beta Tests: Beta games are provided on an "as is" basis with no warranties. Game items, experience points, or status indicators accumulated during beta may be reset at any time. Beta test policies are non-transferable.
THE SERVICE, SOFTWARE, CONTENT, AND GAMES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO THESE LIMITATIONS MAY NOT FULLY APPLY TO YOU.
Content on the internet may include sexually explicit, obscene, offensive, or illegal material created by third parties. The Company disclaims any and all responsibility for third-party content accessed through the Service. You hold full responsibility and risk from your use of the Services and the internet generally.
You agree to defend, indemnify, and hold harmless the Company, its shareholders, affiliates, directors, officers, employees, agents, licensees, and content providers from all damages, liabilities, claims, and expenses — including attorneys' fees — arising out of your use of the Service or any breach of this Agreement.
The Company may terminate this Agreement immediately and without notice if you breach this Agreement, infringe third-party intellectual property rights, or engage in conduct deemed inappropriate at its sole discretion. Termination results in loss of access to your policy without refund of any fees paid for Game Items or nCash.
This Agreement is governed by the laws of the State of California. All disputes shall be resolved in state or federal courts in Los Angeles, California. If any provision is held invalid, the remaining provisions remain in force. You may not assign or transfer this Agreement without written permission of the Company.

Definition: "Channeling Service" refers to any virtual asset-based service (e.g. coins, tokens, in-game credits) operated and managed by a third-party provider, not SMARTBIG.
Disclaimer: SMARTBIG shall not be liable for any inconvenience, transaction errors, monetary loss, fraudulent activity, account compromise, value fluctuations, technical defects, or any damages arising from the use of Channeling Services. All liability rests solely with the third-party provider.
Irreversibility: Virtual asset transfers are irreversible. Funds sent to incorrect or inactive wallet addresses cannot be retrieved or refunded.
No Warranty: SMARTBIG makes no express or implied warranties regarding the security, accuracy, or reliability of any Channeling Service.
User Consent: By agreeing to this User Agreement, you confirm you have read, understood, and accept all risks set forth in this Section.

The Company is dedicated to enforcing these Rules of Conduct for the usage and enjoyment of the Games. The Company has the final decision over what constitutes a violation. Any violation may result in disciplinary actions including account termination and character banishment. Members acknowledge that termination means no refund of any fees paid, and any unused access time, game items, or nCash will be forfeited.
This Rules of Conduct is intended to be read in conjunction with, and does not supersede, the User Agreement and Privacy Policy.
You may use the Service solely for your own non-commercial entertainment purposes by accessing it with the official client. You may not use the Service for any other purpose or via any other method.
SMARTBIG MAY SUSPEND, TERMINATE, OR MODIFY YOUR ACCESS TO THE SERVICE AT ANY TIME FOR ANY REASON, WITH OR WITHOUT WARNING. You may cancel your access at any time by following the instructions at www.netgame.com. SMARTBIG may stop offering and/or supporting the Service at any time.
SMARTBIG will update this Agreement as the law and the Service evolve. This Agreement will terminate immediately upon introduction of a new version, and you will be given an opportunity to review and accept the new agreement. Refusal to accept the new agreement means you will no longer be permitted to use the Service.
SMARTBIG may discontinue, modify, suspend, or change any aspect of the Service at any time without notice or liability. You have no monetary or other interest in any feature or content of the Service. If you do not agree to any portion of the current Rules of Conduct or any SMARTBIG policy, you must immediately stop using the Service.
SMARTBIG does not support cash trade and will not be able to assist if any problem occurs during such transactions. Cash trades are categorized as "unsupported transactions" — SMARTBIG takes no responsibility for the outcome. SMARTBIG may give penalties to players given the circumstances.
The account holder is responsible for all actions on their account. SMARTBIG takes no responsibility for any outcome when you share or trade your account and experience harmful activities. It is the player's responsibility to protect their account information.
SMARTBIG cannot recover lost data for accounts inactive for more than 1 year. Inactive accounts may be defaulted. Report losses as soon as possible after they occur.
